Policies

CONDITION AND RETURN OF VEHICLE

The renter hires the vehicle from Broadway Supercars LLC subject to the standard terms and conditions applicable at the time of rental. Broadway Supercars LLC may, at its sole discretion, terminate this agreement at any time bynotice (verbal or in writing) to the renter, notwithstanding anything to the contrary in this agreement, where upon the renter shall return the vehicle to Broadway Supercars LLC forthwith.

The obligations of the renter and the rightsof Broadway Supercars LLC under this agreement shall continue in effect until the vehicle has been returned to Broadway Supercars LLC and the renter has complied with all his obligations.

The vehicle shall be regarded to have been delivered in good order and without any damage. Any damage not reflected on the rental vehicle inspection of the contract and initiated by both parties will be regarded as new damage.

The said damage will be for the account of the renter as per the rental terms and conditions.

The renter shall at his cost return the vehicle to Broadway Supercars LLC with a full fuel tank at the agreed return time/date. The vehicle shall be returned to Broadway Supercars LLC in the same condition as received, fair wear andtear excepted and at the location where the vehicle was collected.

Broadway Supercars LLC shall at its sole discretion, on the expiry of this contract be entitled to take possession of the vehicle at any location or from whom so ever may be in possession. (Any costs incurred by Broadway SupercarsLLC to retrieve the vehicle will be for the account of the renter).

RENTAL AND DEPOSIT

All charges for the services utilized by the renter for the whole of the rental period as contemplated in the Contract including but not limited to the charges referred to on page 1 on completion of the agreement between the renterand Broadway Supercars LLC. There will be no cash refunds on vehicles returned during the rental period. Should the renter be dissatisfied with the rental vehicle, the rental vehicle may be exchanged should Broadway SupercarsLLC have another vehicle available and there is just cause. The renters deposit shall only be returned by Broadway Supercars LLC once the rental vehicle has been dropped off and undergone a full valet and vehicle inspection. Thiswill be done within 48 hours (during a working week (Monday to Friday between the hours of 8am and 6 pm) unless there is damage to the vehicle and it is necessary to get quotes on repairing the damage. The deposit will only bereturned once it has also been established that there is no damage to the vehicle, no outstanding traffic fines and or penalties due by the renter. The renter is to settle these fines/penalties in full before the deposit will be returned.

USE OF VEHICLE

Free call out only refers to a mechanical breakdown. Should any other problem occur there will be a call out charge of $500 and an additional amount of $ 3 per mile travelled e.g.: keys locked in cars, flat battery due to lights beingleft on, flat tire etc.. The renter shall not use the vehicle for; business purposes, conveyance (people or goods), to propel or tow any vehicle, any motor sport and high risk activity or in any area where there may be a risk or incidentsof civil unrest. The renter shall use thecorrect fuel and oils as indicated on the vehicle manual, check the oil, water and other fluids regularly and contact Broadway Supercars LLC immediately if any damage is detected on any partof the vehicle. The renter shall make adequate provision for the safety and security of the vehicle, in particular, but without limiting the generality of the aforementioned, he shall keep the vehicle properly locked, secured and anyanti-theft device supplied by Broadway Supercars LLC properly secured, when the vehicle is not in use. The renter makes sure that the keys of the vehicle are under the renter’s control at all times. The rental vehicle may under nocircumstances be used outside the borders of the United States. Failure to comply will constitute a breach of theagreement resulting in the Renters’ deposit being forfeited. No exceptions will be made.

THE DRIVER

During the rental period the vehicle may not be driven by any person/s other than the renter or additional driver mentioned on the page 1 of this agreement. The renter warrants that the vehicle will not be driven by himself orany other person whose blood alcohol concentration exceeds the limit permitted by any applicable law or regulation, or whilst under the influence of intoxicating liquor or narcotic and that he/she the driver of the vehicle will havea valid drivers license, will comply with all applicable laws, and will comply in all respects with the provisions of this agreement. If the vehicle is driven by anyone other than the renter, then, without derogating from any rights orremedies which Broadway Supercars LLC may have; The renter shall remain liable for all his obligations in terms of this agreement and he shall be liable to Broadway Supercars LLC as if he had been the driver.

LIABILITY FOR DAMAGE AND THEFT

The vehicle shall be the sole risk of the renter throughout the rental period. The renter shall be liable for any loss or damage to the vehicle and any expenses incurred in recovering the Vehicle during the rental period whether ornot the loss or damage is attributable to fault or negligence providing that if none of the situations set out below, the Renter liability shall be limited as follows;

INSURANCE

All renters must carry a form of insurance to cover damages to the vehicle in the event of an accident. Allowable coverage must be in one of the following forms:

  • Existing Coverage

    If you already have an existing insurance policy on a personal vehicle you own or lease, you can use this same policy to cover your rental vehicle. We will contact your insurance company to verify that you have adequatecoverage in place. If your coverage is insufficient, we will require all driver(s) to purchase additional coverage with their insurance company prior to renting. (Fortunately, it does not matter what car you drive personally. Aslong as you have insurance in good standing, your carrier will cover damages.). Out-of-state renters are required to maintain full-coverage insurance (liability, comprehensive, and collision).

  • Third Party Insurance

    If you are unable to provide your own insurance based on the two options outlined above, there are 3rd-party insurance companies that provide damage waiver products/services. It’s the renter’s responsibility to acquire therequired insurance from these 3rd-party insurance companies.

    To the amount, as deemed appropriate by Broadway Supercars LLC , excess in case of theft or hijack; and any additional amount, excess for drivers under the age of 25 years or has held a driver’s license for less than 2 years(accumulative). To the amount, as deemed appropriate by Broadway Supercar, excess in case of collision or third party claim; and any additional amount for drivers under the age of 21 years or has held a driver’s license for lessthan 2 years (accumulative). The renter shall not be limited If;

    The loss or damage or the event giving rise thereto was caused by the fault or negligence of the renter or driver of the vehicle; The loss or damage or the event giving rise thereto occurred in a situation where no other vehicle or,animal, object or person (in or on the road surface) was involved unless the renter can prove that the loss or damage was not caused by the fault or negligence of the driver of the vehicle. At the time of the occurrence of the lossor damage or in the event giving rise thereto; The vehicle was driven on a road that was not tarred; The vehicle was used for a purpose prohibited ; Or was being driven contrary to any provision stated above; Notwithstandinganything in this agreement, Broadway Supercars LLC shall not be obliged to make any claim which Broadway Supercars LLC may otherwise have had against a third party for the recovery of any loss or Damage to or in connectionwith the vehicle.

ADDITIONAL DRIVER POLICY

Additional drivers may be listed as “authorized drivers” as long as they can provide their own insurance, or they are also listed under the same policy that is being used to rent the vehicle. Each additional driver must complete arental application and will be subject to the same age, licensing, and driving-record restrictions as the primary renter. Unauthorized drivers are not allowed to drive the vehicle under any condition.

RETURN TIMES

Broadway Supercars LLC offers a 45-minute grace period as part of your scheduled return time. If you are unable to return the vehicle on time or within the grace period, you may be subject to additional rental fees. Please planaccordingly so that you can return the car on-time. We work 7 days a week and schedule our,drives one after another. Late returns can affect our ability to,deliver the vehicle on-time for the following renter, leaving everyoneunhappy. Broadway Supercars LLC LLC is not responsible for any loss or damage incurred to your vehicle used to come to our location and left there during your rental period.

CANCELLATION POLICY

If you reserve a vehicle, we will authorize your credit card for an agreed portion of the full cost of the rental/driving package. We offer a 24 hour grace period after booking your reservation to make changes or cancel your reservationfor a 100% refund. If you need to cancel your reservation within 7 days of your rental date, there will be a fee of 50% of the total rental cost, meaning you will only be refunded half initial amount you were charged. If you no-showat the time of your reservation without notifying us ahead of time, you will be charged a cancellation fee of 100% of the total rental cost. Please understand there are no exceptions to this cancellation policy. We do not mean to sound heartless, but the day you rented the vehicle will now become an empty slot and we have other people who may have wanted thedate of your reservation.

WEATHER POLICY

Unfortunately we cannot control the weather, but we try to be understanding and flexible when the weather isn’t cooperating. If you’re unable to use the vehicle during your rental period, we may (at our discretion) be willing toreschedule your rental for another day at no additional charge. This policy is not to be abused – if it's lightly raining or cloudy, we’ll expect you to pick up the car. However, if there’s a severe, inclement weather forecast, we valueyour safety and will work with you to make an alternative rental arrangement. The same applies while you are in possession of the car. If you are unable to use or return the vehicle due to unsafe driving conditions caused by theweather, you may be able to extend your rental at no additional charge. Again, these extensions are subjective and we will expect to discuss them with you – at no time are you to assume you can keep the car.

FUEL POLICY

Broadway Supercars LLC delivers all rental vehicles with a full tank of gas. Renters are expected to return them re-fueled. All vehicles MUST be fueled with Premium Grade 91+ octane gasoline. There are fees for refueling the carwith anything other than 91+ grade gasoline. Lower fuel grades can severely damage the vehicle’s engine. If you decide not to return the car with a full tank, you will be subject to re-fueling fees which will be taken from yoursecurity deposit on file.

REFUND POLICY / MECHANICAL BREAKDOWN

We do our very best to work with our customers and want to make sure you are satisfied 100% with your driving experience. We do not offer refunds for gift certificates or vouchers purchased from any social media sources. Ourweather policy (mentioned above) is one of two refund exceptions. The second is in the event of an unforeseen mechanical failure during or prior to a rental (driver must not be at fault). There’s a big difference between runningthe vehicle hard and abuse. We encourage all drivers to safely enjoy themselves and let the engine stretch its’ legs. But, If you are cruising at 9000 RPM’s for an hour without shifting and the car breaks down, you are most likely atfault. In the event of a not-at-fault breakdown, we will make every effort to get the car back on the road and/or will credit you for the time and miles you were not able to use by giving you the option to receive a pro-rated refundpayment or credit towards a future rental.

DRIVING AREA RESTRICTIONS / PROHIBITED USES

Vehicles rented from our New Jersey office may not be driven outside the following states without prior written approval from Broadway Supercars LLC LLC: New Jersey, New York, Massachusetts, Vermont, New Hampshire, Maine, Rhode Island, Connecticut, Pennsylvania, Delaware, Maryland and Virginia.

The vehicle may not be used:

  • by unlicensed drivers, or drivers whose license has been suspended or restricted; for any illegal purpose or in connection with any illegal activity; to carry persons or property for hire (the vehicle cannot be sub-leased); topush or tow anything; to teach anyone to drive; on any unpaved surface; in any speed test, speed contest, race, rally, speed endurance contest, demonstration, or on or near ANY AND ALL race tracks or road courses. We areextremely serious about our no racetrack rule.

No insurance company will cover the car while on a race track. If you violate this rule, please beware that you will be liable for covering 100% of the vehicle should it be involvedin any accident. If any of these prohibited uses are violated, we reserve the right to end your rental and retrieve the vehicle. Violations are also subject to forfeiture of 100% of the damage deposit – so please, follow these rules.

TRAFFIC TICKETS

Drivers are responsible for all parking, traffic, speeding and/or other tickets or violations issued while the vehicle is being rented. Drives are responsible for paying all fees, penalties, towing charges, impound costs, and any otherrelated costs incurred during their rental period. All traffic fines/penalties incurred by the renter during the rental period are subject to an administration fee of $200.

BREACH OF AGREEMENT

Breach of this agreement occurs but is not limited to when; The vehicle is not returned by the renter as specified; The vehicle is driven by a person not listed as an extra driver ; The loss or damage or the event giving rise theretooccurred in a situation where the vehicle is driven by any person without a valid driver’s license.

RESPONSIBILITY AFTER LOSS OR DAMAGE TO VEHICLE

If during the rental period the vehicle is damaged or any part of it stolen, the renter shall take every precaution to safeguard the interest of Broadway Supercars LLC and do the following where appropriate. He shall notify BroadwaySupercars LLC within 3 hours of the incident; He shall obtain the name/s and address/es of everyone involved and if possible witnesses. He shall not admit any responsibility or liability nor release any party from any liability nor settleany claim against or by any third party nor accept any disclaimer of any liability. He shall notify the police within 24 hours of the occurrence in question. He shall complete and furnish to Broadway Supercars LLC’s standard claimform within 24 hours of the occurrence. He shall make adequate provisions for the safety and security of the vehicle. He shall co-operate fully with Broadway Supercars LLC and its insurer in all ways relating to the occurrence. Therenter shall within 24 hours of receipt thereof furnish to Broadway Supercars LLC any notice of claim; demand or Summons which the renter or driver may receive in connection to the vehicle. The renter shall be financially liable,as determinable based on the nature of the incident and damage incurred. Broadway Supercars LLC shall work closely with the renter’s insurance company to settle all accident claims to the satisfaction of Broadway Supercars LLC.

NON-LIABILITY

Neither Broadway Supercars LLC nor any of its members, employees, servants, consultants, directors, owners or agents shall be liable for any loss or damage, whether direct or indirect, consequential or otherwise arising from therental by the renter of the vehicle, including and without limitation any defect or mechanical failure of the vehicle or the failure of Broadway Supercars LLC to detect defects or mechanical problems with the vehicle and whethersuch loss or damage results from breach of contract or derelict which may be suffered by the renter and/or any third party and/or passenger/s. Broadway Supercars LLC its members, employees, servants or agents are accordinglyindemnified by the renter or his estate against any claim/s of any nature whatsoever and howsoever arising from any damages or loss which might be instituted against it, arising from the renting of the vehicle contemplated inthese terms and conditions.

GENERAL

This document contains the entire agreement between the parties regarding the matters contained herein and neither party shall be bound by any undertakings, promises or the like not recorded herein and signed by or on behalfof the renter and Broadway Supercars LLC. The renter authorizes Broadway Supercars LLC to insert any particulars in the agreement, which are not known or unavailable at the time of signing or to rectify any bona fide errors in anyfact, figure or calculation. This agreement and all matters or disputes arising from it shall be governed in accordance with the laws of the United States. The renter is not entitled to cede any of the rights under this agreement or tosub-let or part with possession of the vehicle, its tools or equipment or any part of it.If Broadway Supercars LLC institutes any legal proceedings against the renter to enforce any of its rights under this agreement, it shall be entitledto recover from the renter all the legal costs incurred. If the renter enters this agreement on behalf of any principal, disclosed and/or undisclosed, he shall be personally liable jointly and severally with the principal.
